To fight the growing threat of counterfeiting and piracy to the economy, jobs, and consumer health and safety, the business community, led by the U.S. Chamber of Commerce's Global Intellectual Property Center, organized itself through a broad-based business coalition, the Coalition Against Counterfeiting and Piracy (CACP). Formed in 2004, the CACP has grown to more than 600 members, making it the largest business coalition of its kind. The coalition is committed to increasing the understanding of the negative impact of counterfeiting and piracy and to finding real solutions by working with governments, industry, opinion leaders, the media, and consumers. This year, the CACP is focusing on a few primary goals, which we believe will make a measurable impact in the fight against counterfeiting and piracy.

Campaign to Protect AmericaIn June 2007, the CACP launched the Campaign to Protect America, an aggressive legislative package to combat counterfeiting and piracy and IP theft. Many submissions from the Campaign to Protect America became part of Senate bill 3325, the PRO-IP Act, that was signed into law in October of 2008. This act is a critical step toward improving the federal government’s ability to protect IP. This year the CACP will be working to fully fund and implement S. 3325 and pass the remining pieces of the Campaign to Protect America including:
Model StateBuilding on our efforts at the federal level with the Campaign to Protect America the CACP, working with Attorney General Baker, launched an initiative to turn Georigia into a model state for IP enforcement. General Baker has dedicated an assistant attorney general to counterfeiting and piracy and we are working with him to form a statewide task force modeled after the task forces in North Carolina, New York, and Los Angeles. On May 27, SB1631 introduced by Senate Majority Whip Ira Silverstein (D) passed the Illinois State Senate. The bill will protect consumers and legitimate businesses against counterfeiting and piracy in the state, while protecting jobs in the industries that make these products. The bill codifies the definition of a counterfeit mark with federal law and includes increased penalties–especially for repeat offenders and criminals trafficking goods that could cause bodily injury or death. The bill also includes improved forfeiture and restitution provisions. SB 1631 awaits the Governor's signature.
Anti-Counterfeiting Trade Agreement (ACTA)In 2007, the United States Office of the Trade Representative launched of the Anti-Counterfeiting Trade Agreement (ACTA), a proposed multilateral trade agreement aimed at enhancing IP enforcement. The governments of the United States, Japan, Switzerland, Australia, New Zealand, South Korea, Canada, Mexico and the European Commission are currently engaged in the negotiations.
